Clients or prospective clients will sometimes ask me whether their inheritance is going to be subject to division in divorce court.
The answer is "probably not" but it depends on a lot of things to consider, and I'll go over a couple of them.
Generally speaking, in Nevada, community property states inheritance is not community property subject to division, but if you transmute that into community property by giving some of it to your ex, or commingle it in a joint account, then it might be considered community property subject to division.
The other ways that your ex could get access to that money is if you owe child support or alimony and you fail to work and continue to work so that your income can be considered. then the court could award part of your independent wealth for purposes of alimony and child support. #inheritance #divorcecourt #communityproperty #commingle #jointaccount #childsupport #alimony #independentwealth #lasvegasfamilylawyer #divorceattorney
